Acerus Comments on Decision Regarding Litigation

Acerus Pharmaceuticals Corporation (TSX:ASP) (“Acerus” or the “Company”) today announced that the Divisional Court of the Ontario Superior Court of Justice has dismissed the appeal brought by Mr. Eugene Melnyk of the Order of the Honourable Justice Wilton-Siegel dismissing Mr. Melnyk’s motion for leave to commence a derivative action in the name of the Company against certain of the Company’s directors and officers. “We vigorously defended against this appeal brought by Mr. Melnyk and are very happy with this decision,” said Luc Mainville, Interim Chief Executive Officer of Acerus.
